Sen Craig wasn't in the courtroom but his lawyer was, and he argued that Craig should be able to wriggle out of his guilty plea from last year.
His mouthpiece argued that there wasn't sufficient evidence in the police complaint and some other procedural stuff.
The judge didn't buy it and said the arresting cop saw a fidgety Craig staring "through the crack between the stall door and its frame,” peering so closely at Sergeant Karsnia that the officer could see that the senator “had blue eyes.”
Not so, said the lawyer.
"“We don’t know how long the crack is, how big the crack is,” Mr. Martin said. “We don’t know,” he said, if Senator Craig simply glanced at the crack twice “or if it was continuous staring.”
